I'm just shell shocked. OK here's what happens last night. Go out xmas shopping and dinner. On the way home on a major shopping road and am in front of a church where some sort of concert was going on (folks in Tuxes) and this Ford Escape a HALF A BLOCK AWAY starts backing up towards me. No biggie she will stop. . . Flash lights. . . honk horn. . she SPEEDS UP. I try to reverse but theres a car behind me. BANG hits my 2 week old M45 Sport. W T F! I was nice about it and she apologized profusely and said she was "looking for a parking spot". Of course, the clear answer is, you drive backwards without checking behind you or looking in the mirror even? What do you do when you drive forwards, close your eyes? She wants to pay for the damages which include Bumper, totalled, hood, totalled, front right 1/4 panel needs paint, front right light and fixture, totalled. She doesn't want insurance to handle it. I got all her info and double checked she was insured. I'm going to the body shop tommorow a.m. and getting a high estimate and then I'm literally driving it to wherever she is and getting a check or having her pay the body shop right away. If she has some sort of change of mind "oh I don't think I was reversing; he hit me" I'm going to sue the living shit out of everything that moves. 2 witness and very obvious physical evidence (unless cars that do the hitting take the damage these days!) Jeez, 20 years driving no accidents, # of cars in the body shop in last month? THREE. Argh, im about ready to chew nails.

Trincap: I would have called the police no matter what so you have legal documentation of the incident. I've seen your worst fear happen too many times in my career. It's one thing to not have it go through insurance and pay. Another thing to have a change of mind and change the entire story the next day. A police report stops the story from changing and allows the freedom of going through insurance or paying out of pocket.

No she was old and NOT hot. OK more to the story. I called her today and was going to file an insurance claim if I didn't hear from her by the end of the day. She called me back and we spoke. She actually is quite nice and left a message on my cell again re iterating that it was her fault. (SAVE THAT MSG!) She wanted it handled quick cause she was heading to San Diego on Thu. She said she had gotten into another accident 2 years ago (no surprise there) and the victim claimed back problems which was b.s. but the insurance company gave him 3k and now theres a "accident with Injury" on her file which doubled her rate. Actually, that makes sense. She asked me if I was ok. I said Yeah I think I'm fine. (ie. Ill change my mind if this becomes a hassle) Anyway, this is how im handling it. Bringing it to autobody place TOMM. morning and asking my body guy (friend of mine) to give me an estimate that is an extremely accurate one and build in wiggle room if he needs. She will pay him TOMMOROW and when it's done I'll shoot her a receipt and if there's left over dough then refund the diff. Fair to all. She heartedly agreed. I'm pretty sure since she did such a Fucked up thing and she knows it, she's a little scared I'm gonna claim all kinds of wild injury and jack her which isn't my style. Anyway, more on this crap tommorow. Hopefully this works out nice and simple.

Re: women drivers. OMG I agree. Men might be more aggressive and do stupid things but the outright run of the mill dumb ass thing? Women. hands down. Even my WIFE agrees and she's a Feminist. I swear I'm going to stick a cell phone somewhere the next dumb ass woman that cuts me off while on one of those damn things. Females have lower driving insurance because males do riskier things in their car. Not dumber, riskier, as in drive 85 down the highway. That increases their injury liability number which makes up the majority of insurance. After all, a car accident is usually 20k top end with the occasional one higher. The car accident WITH injury is possibly millions. That doesn't mean that women aren't far worse drivers and do far more dumb ass things like banging into your car, not looking before turning, not knowing to use the blinker. Opening their car door to ding yours, talking on cell phone while drinking latte and putting on eyeshadow. In fact, studies have long shown that men have better spatial awareness then women while women have superior empathic skill (Who the fuck cares). That's why they generally do better in Geometry than women. To sum it all up, I'm moving to Saudi Arabia, they don't drive there.

You should check you policy. Some claims are denied because you didnt inform your insurance company within a set amount of time (if you decide to file a claim).

Generally speaking no time limit exists. Also, if you do call the company sometime they have to file a claim since you did notify them and depending on the company it may be held against you. However, every state does have different laws...

Yes I have plenty of cars. They all seem to be going to the shop lately (GOD DAMN IT!!!!). The estimate came in. hahahaha $7,500. OMG. I assume the woman is going to let insurance take care of it. I already made an appt with the doctor and chiropracter for my wife and I. It GAULS me that I have to do that but. . . welcome to the 21st century.
